Gault and Smith Win Appeal Before Fifth Circuit

On January 24, 2017, the U.S. Court of Appeals for the Fifth Circuit issued a seven-page opinion affirming the trial court’s dismissal with prejudice of plaintiff’s wrongful death claims in Sonja Henderson v. West Jackson Student Housing, et al. Forman Watkins represented a court-appointed receiver of property headed for foreclosure, which was accused of negligently causing the death of an individual involved in a shooting on the property. Win Gault and Peyton Smith led the appellate defense, seeking to uphold the dismissal based on the immunity of the court-appointed receiver of property.
